As to his legal problems, as I understood it he used lawyers to claim immunity as an MEP in the case brought against him, and was successful.

However, when he is no longer an MEP he will presumably be called to account.

He lost his parliamentary immunity. Despite this, he has still to be convicted of anything.

If he loses his seat, look at who is next on the SE list. Doesn't bode well, does it?

Given that, I hope he keeps the seat.

Ashley Mote has asked a lot of very pertinent questions in the EU Parliament. I have heard him speak, and was impressed with the arguments he put forward regarding missing accounts etc.

Default Ashley Mote MEP is a hard worker

Ashley Mote is a hard worker.

But as an independent with no party structure to back him up at election time, he has little chance of re-election in 2009. If he stands again, that is.

The only other alternative for him is to join a political party (I don't mean UKIP, obviously as he was suspended from it and is not in it any more) - or start up a new one of his own.

David Lott? If he's retired, mightn't he decline in favour of Tim Cross?
(Craig Mackinlay is no longer a party member)

Mote applied to the EP to waive his parliamentary immunity. This application was rejected, for reasons including the fact that MEPs are supposed to have the same legal protection as the MPs of their own country. UK MPs don't have parliamentary immunity. See the EU website for the documentation.

Notwithstanding, Mote then applied via his lawyers to the Court of First Instance, requesting that the decision be overturned. That was in late 2005. There's no update on the relevant EU website as far as I can tell.

I assume that the UK court has to wait for the EU decision before the case can move forward.

Call me cynical, but it would seem to be in Mote's best interests for his EU case to take as long as possible. If he does owe money, as is alleged, the longer this goes on, the more chance he has of paying the money back before his UK case goes forward. :?

OK thanks. So he only has temporary immunity, pending the European Court of First Instance making its mind up.

Spoonplague, I hope he would decline, but given that he has proven his keeness to get his nose into any available trough, and at anybody's expense, I fear he would jump at the chance.

He retired to France, by the way.
