Didn't even get round to getting all the paperwork (inc contract) so I don't really know... Anyway I told my advisor at the jobcentre about it. Plus on Wednesday senting my Mum in their to see if he will offer her the job he turfed me out of, if so then it's clear what his game is!! Thanks for you advice Rab C.

Firstly you don’t NEED to get paperwork, especially if you got a letter offering you the job. Even if you did not the very fact that you were working there is proof that a contract of some form must have existed, and if he did not give you a paper copy on day 1 setting out your terms of employment including hours and remuneration etc. then he acted illegally so he’s in trouble straight away.
Next your Job Center Advisor isn’t the person who can help you with this, his agenda and terms of reference are too constrained. In your position I would be taking the position not simply of having been treated unfairly, but down right abused and taken advantage of, and be seriously and big time pi*sed off and be out for blood. By now I would have been down to the CAB, and if they didn’t take the matter very seriously then I would be hot foot to a local solicitor. Get the name of one who specialises in employment legislation from the CAB and even asking may move the CAB person to do what they should already be doing for you, and take advantage of the initial free consultation that you will get under the terms of the UK Legal Aid scheme that all solicitors sign up to. There’s actually a hell of a lot more involved than you seem to realise. Quite apart from the disgraceful manner in which you seem to have been treated there is also the matter of the risk that you were in as it is highly unlikely that the manager / franchise owner had you covered by his Employers Liability Insurance, in fact it is very possible he doesn’t even have such cover. Others working there may also find themselves seriously out of pocket if this were to be the case and they were injured at work. Then there is the matter of the payment of your NHS contribution for the period you worked there as well as any tax deductions made from the pay that you received. Then there is the matter of notice period. What were the hours that he expected you to work? If they amounted to a full week then you will be eligible for at least pay in lieu of notice unless your employment was terminated for gross misconduct which by the sounds of it is not the case. On that matter did you get a pay slip when he gave you the big heave-ho and payment for the hours worked? You are required to be given one BY LAW and if you did not then that is another matter of concern. There’s a whole crock of the brown and nasty about what seems to have taken place. Now, as regards your mum going down to see if he will offer her the job he bounced you out of. If he does then what will your next move be? Go down and tell him what you think of him? Big deal. I would be thinking far more about taking cash out of the SOB than telling him what I thought because based on what you’ve written he’s probably been insulted by professionals in the past and it would simply be ducks water off his back (?) One other thing that might be worth consideration would be to grass him up to Pizza Hut inc. They just LOVE to hear of people damaging their reputation. Look, GO FOR THE JUGULAR. He deserves it. |

You could have done a rapid reclaim. That's how you start claiming again if a job has fallen through.
I used to work for the DWP.

I just had an idea as well if I tell Carole my advisor to ring him up asking if any Receptionist jobs around going and see what answer he gives her. I am just doing my Mum a CV especially to hand in to Pizza Hut, with the address changed. I will then talk to Carole about what kind of case she thinks I have then regardless of the outcome of the talk, go and see CAB and see what they say.

Good advice from some of our more sensible friends on the forum but then again Im not very sensible.
A simular situation happened to my niece in 2006 while she was away at Uni,a few well placed shots to the ribs of the arsholes involved brought forward the correct remittance for services rendered. Just a thought |

Carole rang him, she told me this today. Before she rang I was at home and got a bank statement showing money had been pay in. Carole while talking about her ringing him said that he said that he paid me. So I guess that's it for me pursuing it...
Funny though, I mentioned to her about him interest in getting a CV off my my Mum who I used to test him and the info from her when she was in their about him interviewing a lady for a driving delivery job. Strange.....

Doesn't necessarily mean anything. The employer has to phone a dedicated team, in Swindon I think, to get the job removed. Most employers, having found their candidate, do not remember to do this. Others do remember but the service is slow and so jobs may remain on the site for weeks after they've been filled.
When the government says there are so many thousands of jobs, guess where they get their data...
