Given that he contested Wakefield in 2005, isn't John Upex the 'de facto' UKIP candidate?

In my opinion, UKIP can't and shouldn't stand in Haltemprice because their position has already been compromised.
Davies resigned and said that he would fight the seat on the principal of civil liberties - in particular the issue of 42 days detention without trial which I have read he was instrumental in persuading Cameron and blue labour to oppose. The vote was lost BUT Dr Bob - UKIP's sole representative in the House - voted with the government. Therefore, if UKIP were to stand, they would be in an evidious position on the main reason for the election taking place - do they support detention without trial as suggested by their MP's vote or are they against it as suggested by the support given by a UKIP MEP and posted on their website for Davies' stand.
Also, after the poor result at Henley - quite frankly, I find it unbelievable that the BNP can garner more support in a constituency like Henley, not somewhere I would have thought would have been their natural hunting ground, UKIP could do without another weak showing -previous election results in the constiuency would not seem to offer much hope Haltemprice and Howden (UK Parliament constituency) - Wikipedia, the free encyclopedia if they are to maintain credibility.
