In April 1985, Lauder-Frost's wife left for the United States to live with her lover whom she subsequently married. Lauder-Frost was awarded full custody of his daughter, then one year old. However she was subsequently abducted twice, and, on both occasions, taken abroad. He was eventually successful in securing her return to Britain following actions he raised under the Hague Convention on Child Abduction. [14] [15]
In January 1992, charges of embezzlement were laid against him, and he was prosecuted on eight specimen charges of theft totalling £8,700 (the prosecution stated the total amount stolen as £111,642) from the district health authority for which he worked as an accountant. His barrister said that Lauder-Frost had stolen the money in order to finance his cross-Atlantic battle to win custody of his daughter. He was convicted in November of that year and jailed for two years.[16]. An application for Leave to Appeal was dismissed on 7 December 1992 by the Court of Appeal (Criminal Division).[17]. He filed at Duns Sheriff Court to appoint a Trustee in Bankruptcy under the Bankruptcy Act (Scotland) in April 1993 which resulted in the sequestration of his estate.[
