So would you agree that Nick was forced to go to court in order to get these lists back?

I think you will find that the BNP still has the current membership list.

I'm trying to clarify what was taken. Was it the only up-to-date list, leaving the BNP without knowledge of its members, or just one of many copies, as Nicholla Smith argued when I presented this question to her earlier on the other forum? Even if the latter, it might have warranted action - definitely for the former.

I think both cases are actionable. The list was being used by the 'rebels' to contact BNP members to encourage them to leave the Party. I was one of them and objected to the fact that non-BNP members were using my personal details.

This is one of the main issues that turned a lot of potential 'rebels' against them, and made those who supported them initially, realise something wasn't quite right.

Yes, both are actionable - i only hesitated with the latter because of the costs and risks involved. but i can understand your feelings, and at the time I questioned whether such actions wouldn't turn people against them.

Neither of the two bulletins issued by the "rebels" encouraged the membership to leave the BNP, they did however suggest that members held off renewing their memberships until the usual February cut off date.

Do you not think that they had a duty of care to the membership to let them know what was wrong/going on within the party so that the membership could decide for themselves?
