Correction, you have no rights when it comes to someone elses property. Pubs are not a government service, they're privately owned businesses. Would you presume you had the right to enjoy someone else's garden?
Smoking policy is a subject for landlords. If there was truly money to be made by having a non-smoking policy then that's what they would do.
I still don't see what was wrong with the old arrangement of having smoking and non-smoking sections.

The building may be privately owned, but it is a public service, which is regulated and therefore the government does have a say.
