I am not sure what Section 19 (4-5) is talking about, but I found this on a web site:

So the party may be able to hold the information of past members and also Excalibur for business reasons such as they have been doing already. The Party using data they have legally been given and Sadie and Co using data they were no longer entitled to use are totally different situations.
Baisically its like an employee who has been sacked/resigned of ASDA taking their customer details database and giving it to TESCO to use.
